All brand assets are the exclusive property of SYVÉ. No right, title, or interest in any SYVÉ intellectual property is transferred to any third party through partnership, wholesale, distribution, or any form of commercial engagement, unless expressly granted in writing by an authorised representative of SYVÉ.
Trademark Protection
SYVÉ actively registers and maintains its trademarks across all key markets and product categories. The SYVÉ name, logo, and related marks are registered or pending registration in applicable jurisdictions under the Nice Classification system, including Classes 18, 24, 25, and 35.
The SYVÉ trademark may only be used by individuals, entities, or organisations that have received written authorisation from SYVÉ. All authorised uses must strictly conform to SYVÉ's current Brand Guidelines. Any use that dilutes, tarnishes, blurs, or otherwise harms the distinctiveness of the SYVÉ mark is strictly prohibited.
The following uses of the SYVÉ trademark are expressly prohibited without prior written consent:
- Incorporating the SYVÉ name or mark into any third-party business name, trading name, or company registration
- Using the mark in any domain name, social media handle, or digital identifier
- Creating merchandise, promotional material, or derivative products bearing the SYVÉ mark
- Registering any mark that is identical or confusingly similar to SYVÉ in any jurisdiction
- Using the mark in any manner that implies an endorsement, sponsorship, or affiliation that does not exist
- Using the mark on products or in categories not covered by a formal licensing agreement
SYVÉ conducts continuous monitoring of trademark databases, marketplace platforms, and public registrations globally. Any third-party application for a mark confusingly similar to SYVÉ will be opposed through all available legal mechanisms.
Copyright Protection
All creative output produced by SYVÉ or commissioned on behalf of SYVÉ — including garment designs, surface prints, graphic artworks, editorial imagery, film content, website design, and written content — constitutes original works protected under applicable copyright law from the moment of creation.
Each SYVÉ seasonal collection and capsule line is treated as a body of original artistic work. The silhouettes, cut details, embellishment techniques, and original surface decorations contained within each collection are protected as artistic works and may not be reproduced, adapted, or distributed without the express written consent of SYVÉ.
All SYVÉ photography, campaign imagery, look-book content, social media creative, and website assets are copyright protected. Third parties may not use, reproduce, distribute, broadcast, or publicly display SYVÉ imagery without a formal licence. Limited sharing for editorial or press purposes is permitted only with proper attribution and subject to SYVÉ's Media Guidelines.
Any authorised reproduction of SYVÉ copyright material must carry a clear copyright notice: © SYVÉ [Year]. All Rights Reserved. Removal or alteration of copyright notices constitutes infringement and will be subject to enforcement action.
Anti-Counterfeiting & Product Authenticity
Genuine SYVÉ products are manufactured exclusively through authorised production partners bound by SYVÉ's Supplier Code of Conduct. Each product carries SYVÉ's proprietary authentication identifiers, which may include holographic labels, unique serial codes, NFC-enabled tags, or other security features as determined by SYVÉ from time to time.
For the purposes of this policy, counterfeit SYVÉ goods include any product that:
- Bears the SYVÉ mark, name, or any confusingly similar mark without authorisation
- Is produced, packaged, or presented to mislead consumers into believing it is a genuine SYVÉ product
- Is sold, promoted, or distributed as genuine SYVÉ merchandise without authorisation
- Replicates any distinctive SYVÉ design element, trade dress, or product configuration
SYVÉ employs continuous market surveillance across physical retail environments, e-commerce platforms, social commerce channels, and international marketplaces. SYVÉ cooperates actively with customs authorities and law enforcement agencies to identify and remove counterfeit products from circulation.
Consumers are encouraged to purchase SYVÉ products exclusively through the official SYVÉ online store and verified authorised retail partners. SYVÉ cannot guarantee the quality or safety of products of unknown provenance.
Licensing & Authorised Brand Use
SYVÉ may, at its sole discretion, grant licences for the use of the SYVÉ brand in connection with specified product categories, territories, or marketing activations. All licences must be formalised through a written Licence Agreement executed by an authorised officer of SYVÉ. Verbal agreements, informal understandings, or historical usage do not constitute a valid licence.
Authorised wholesale partners and retail stockists are granted a limited, non-exclusive right to use the SYVÉ name and assets solely for the purpose of marketing and selling genuine SYVÉ products within their authorised territory. All such uses must comply with SYVÉ's current Brand Guidelines. Partners may not modify, adapt, or combine SYVÉ brand assets with their own brand identity without prior written approval.
All collaborative projects, co-branded collections, and brand partnerships must be established through a formal Collaboration Agreement. The terms governing the use of the SYVÉ identity, including credit lines, asset placement, and marketing approval rights, shall be defined in that agreement.
Members of the press, media, and fashion editorial community may use approved SYVÉ imagery and brand references in bona fide editorial contexts, subject to proper attribution and compliance with SYVÉ's Media Kit guidelines. Advertorial or commercially motivated use requires a separate formal agreement.
Digital & Online Brand Protection
SYVÉ maintains exclusive ownership of all domain names incorporating the SYVÉ mark across key top-level domains. Any registration, use, or trafficking of domain names that include or are confusingly similar to SYVÉ constitutes cybersquatting and will be pursued under the UDRP and applicable national law.
No individual, business, or organisation may create social media profiles or accounts using the SYVÉ name or mark in a manner that could mislead the public as to their relationship with SYVÉ. SYVÉ's official accounts are verified. Fan accounts and community pages are tolerated but must not imply official status or engage in any commercial activity.
The sale of SYVÉ products through third-party e-commerce and marketplace platforms is permitted only for authorised retail partners operating within the terms of their partnership agreements. SYVÉ actively monitors and reports unauthorised listings, counterfeit sellers, and grey-market activity across all major platforms.
Unauthorised parties may not bid on SYVÉ trademarks as keywords in paid search advertising. Authorised partners may use the SYVÉ name in descriptive text solely to identify themselves as an authorised stockist, without suggesting a closer relationship with SYVÉ than authorised.
The use of SYVÉ's brand assets, design archive, or creative output to train artificial intelligence models, generate synthetic SYVÉ products, or produce AI-generated imagery mimicking the SYVÉ aesthetic is expressly prohibited without a written licence. SYVÉ reserves the right to pursue all available remedies against parties engaging in such activity.
Trade Secrets & Confidential Information
All information relating to SYVÉ's unreleased collections, design concepts, seasonal direction, material sourcing, supplier relationships, retail strategy, and pricing architecture constitutes confidential and proprietary commercial information. All parties with access to such information are bound by strict confidentiality obligations.
All employees, contractors, collaborators, suppliers, and business partners who access confidential SYVÉ information must execute a Non-Disclosure Agreement prior to receiving such information. Confidentiality obligations survive the termination of any relationship with SYVÉ for a period of no less than five (5) years, or indefinitely in the case of design IP and trade secrets.
Access to confidential SYVÉ information is limited on a strict need-to-know basis. Any breach of confidentiality obligations will result in immediate termination of the relationship with SYVÉ and will be pursued through all available legal channels.
Enforcement Framework
SYVÉ maintains a dedicated Brand Protection function responsible for continuous monitoring of trademark databases, customs records, e-commerce platforms, physical markets, and digital channels, in collaboration with external brand protection specialists and law enforcement.
SYVÉ applies a proportionate and graduated response to identified infringement, which may include:
- Formal cease-and-desist correspondence
- Platform takedown notices and removal requests
- Customs border detention and seizure requests
- Opposition and cancellation proceedings before intellectual property offices
- Civil litigation seeking injunctive relief, damages, and account of profits
- Criminal complaints where applicable under national law
Authorised partners who fail to comply with this policy or SYVÉ's Brand Guidelines will be notified in writing and given a reasonable opportunity to remedy the non-compliance. Persistent or material non-compliance will result in termination of the partner relationship and may give rise to legal claims for breach of contract and intellectual property infringement.
SYVÉ reserves all rights in respect of its intellectual property. No action, inaction, or delay on the part of SYVÉ shall be construed as a waiver of any right. SYVÉ expressly reserves the right to take enforcement action at any time in respect of any infringement, whether past or continuing.
